Terms and conditions of sale

 

These terms and conditions are for your peace of mind while ordering services from with us. This also acts as a guide as it outlines the rules and regulation while purchasing from us in-person and via the Internet. Please note, these terms and conditions do not affect your statutory Rights.

Online Orders/Services

Namesfx provides a service for businesses to build and grow online services on the world wide web, as well as other website and online activities to promote and add value to your website. We also sell services and consumables, such as Google ads and other online activities to build and grow your business via this website www.namesfx.co.uk.

Sales and Refund Policy

Order Confirmation

You will be notified via email or phone to confirm your order,Shortly after our conversion to agree requirements and set start and end dates before your order is finalised and we generate an invoice for payment, you will be kept informed of all work being carried out.

Submission of an Invalid email address could delay your order. Our payment method are either by direct bank transfer or PayPal, when paying online and during the checkout process, you will be asked to complete your payment details. All fields indicated are compulsory and must be completed. You will also be asked to accept these terms and conditions of Namesfx by selecting a check-box. This must be accepted in a view to completing your order.

Please note that we use an encrypted secure payment mechanism and will only use your information in accordance with our Privacy Policy.

If your payment is cancelled or rejected due to your payment method we will not be able to start work until this is corrected.

Returns Policy
If Namesfx is unable to provide the product or service you ordered, we will always attempt to come to an amicable solution, however if you have paid for a service and we have complete the service, we cannot get that time back so for that reason we do not give refunds and if your project is not completed then we will be happy recommend other online business who might be able to help you complete your project successfully, we hope this will offer you a satisfactory replacement.

 

Time, Charges and Timescales (All Services)

The timescales of each project vary, depending on the type of service ordered or the service required. If you select (i.e. website design), the time scale is usual estimated to be about 7 days lack of communication and other unforeseeable disruptions may affect delivery service completion times.

Hand over /Delivery

On completion we hand over all user names and passwords for you to adminisster your website, we remove all reference to Namesfx and remove any emails used for the setup of your website – unless agreed that we should hold your admin account details for adding other service at a later date, or for those cases where you can’t get access to your website.

Additional Services

Where you have ordered a service we may use a 3rd party supplier to fulfil your order which may incur additional cost. Where a service can’t be performed on the particular Host because of different version of software or services provided – Namesfx will notify you either by phone or email ASAP. If your order results in a delay to your project for more than 10 working days, you will be contacted in order to establish an extension to the agreed delivery date, or a full refund.

Website Backup

Once your website has been completed we take a back copy for easy replacement should anything happen to your installation, there is no cost for this and we are happy to keep a copy of all user name and password used and happy to forward them to you on request.

Errors & Omissions

Every effort is made to ensure the accuracy of the information we provide on your website, and we apologise in advance if there is an odd word misspelt, and we will correct promptly when brought to our attention. Website success

Namesfx cannot guarantee the success of your business website; and cannot guarantee any Google Adwords or other advertisers campaigns in which we are adverting your business online to gain customer or receive visit.

Complaints

Every effort is made to ensure the accuracy of the information we provide and to make sure our service if of the highest quality. However we are human an create all our image and code all pages by hand and sometimes errors will creep in however, they will be corrected promptly when brought to our attention. Should you be dissatisfied with us in any way with the quality/value of our services or even our service, please do not hesitate to drop us a line or two. Statutory Rights

Your statutory rights are in no way affected by these terms and conditions. Promotions and Promotion Codes If you have a promotional code, you need to enter this into the appropriate box during the check-out process. Promotional codes remain the property of Namesfx Limited, are non-transferable and may not be reproduced in any form. Namesfx reserves the right to remove promotion codes at any time and without warning. Namesfx reserve the right to withdraw offers at any time. Some promotions may not combine with other promotions on site, and if so, the best offer will be applied to your order. Please note: If you buy on a discounted multiple offer, individual services cannot be cancelled once work has started/completed and no refund is given, Only one promotional code can be used per service ordered.

Other Forms of Ordering/Payment

We are able to process orders and payment over the telephone and via email.

Payment

We accept direct bank transfer however if that is not possible we accept payment via Debit/Credit card in UK Pound Sterling (GBP) only. Customers outside the UK will be billed in Sterling. Cheques/postal orders etc are not accepted. We utilise Paypal to process payments on-line. No charges are levied to you for making this payment by credit/debit card.

Payment Security

Your payment details are submitted to Paypal via a secure window and are not recorded or retained by Namesfx. They utilise industry-standard Secure Sockets Layer (SSL) technology to allow for the encryption of your card details.

This technology includes the following features:

Authentication – this assures your browser that your data is being sent to the correct computer server, and that the server is secure. Encryption – this encodes the data, so that it cannot be read by anyone other than the secure server.

Data Integrity

This checks the data being transferred to ensure it has not been altered.

Returns and Cancellations

With the exception of Special orders (where special rules apply) Namesfx will not refund or replace a website once completed for another one because the focus of the project has shifted.

Replacement services are offered at Namesfx’s sole discretion.

Orders involving website repairs cannot be cancelled once work has commenced. Unless you specify to the contrary – you agree to waive your right to protection under the Consumer Protection (Distance Selling) Regulations 2000 to cancel your order within seven (7) working days following the date on which you authorised Namesfx to commence provision of the services.

Our non refunds policy if for orders cancelled under the provisions of the Consumer Protection (Distance Selling) Regulations will be processed in accordance with your legal rights. For further information about your statutory rights, contact your local authority Trading Standards department or consumer advice centre (for example the Citizen’s Advice Bureau if you are in the UK). If you are a non-EU customer, please note all transactions with Namesfx are governed by the Laws of England.

In the UK, delivery charge refunds can only be made in accordance with your legal rights under the Consumer Protection (Distance Selling) Regulations 2000 and other applicable legislation. Similar rights may apply for some international deliveries. For further information about your legal rights contact your local authority Trading Standards department or consumer advice centre (for example the Citizen’s Advice Bureau for UK customers). See Returns & Cancellations section below).

If you are considering cancelling or wish to cancel a product/service you have ordered on-line, please be aware of the following terms that apply:
• Legal rights of cancellation under the Distance Selling Regulations available for UK or EU consumers do not apply to services which has been started.
• Additional Terms and Conditions of Sale apply to promotional services provided by 3rd party like Google adwords.
• You should check all software you receive against your requirements. If the products you receive does not perform as described then you must inform Namesfx (by phone or e-mail) within the 7 days allowed us to contact the supplier and negotiate a refund, remember we will be governed by the terms and conditions of the supplier.
• Other cancelled services please try to do this before agreed start dates. If you want to cancel a service we have already started that failed to work or was incorrectly applied, then you must inform Namesfx at once so we can stop work in accordance with the Distance Selling. Once you notify us of a cancellation it will be removed from your website as soon as possible.
This is not intended to be a full statement of all your rights under the Distance Selling Regulations. Full details of your rights under the Distance Selling Regulations are available in the UK from your local Citizens’ Advice Bureau or your Local Authority’s Trading Standards Office. Where you are cancelling your order within the cooling-off period because of a change of mind no refund will be offered. If you return software we have brought on your behalf, please understand that we will be governed by the software vendor terms and conditions and returns policy.

International Payments
Payment – will be taken in pounds Sterling. International credit card providers or banks will determine the exchange rate and may add an additional processing or administration charge in relation to such payment which international credit card holders will be liable to pay. Namesfx services are sold subject to UK law but excluding import/export fees/taxes. The recipient may have to pay additional fee’s in conversion from international currency to UK pound sterling.
